What it does

Following the expiry of the Section 122 measure, the USTR final action in the Section 301 forced-labour investigations took effect at 12:01 a.m. on 24 July 2026, covering 60 economies. India is placed in the lower 10% tier alongside Bangladesh, Pakistan, Sri Lanka, Indonesia, Cambodia, Mexico, Canada and the United Kingdom. The duty stacks on top of MFN.

Context

The practical consequence for a US buyer is that Indian goods now land 2.5 percentage points cheaper at the border than Chinese or Vietnamese equivalents, before any other consideration. Goods already subject to Section 232 are broadly exempt from the Section 301 duty but carry their own rates — steel, aluminium and copper at 50%. Several hundred exclusions apply across agricultural inputs, pharmaceuticals, semiconductors, metals and textiles. India has sought a review of the determination.
